Agreement to Terms

These Terms of Use ("Terms") are an agreement between you and Simon Grimm, Germany ("we", "us"), the developer of TinyHarvest ("the App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Our Privacy Policy explains how we handle your data and forms part of these Terms.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial entertainment.

This license does not include the right to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App, except where the law allows it
• Remove any proprietary notices or labels
• Use the App, your account, or in-game items for any commercial purpose

Accounts

You can play without an account; your progress is then stored only on your device and may be lost if you delete the App or change devices. To save your farm to the cloud and use social features, you can sign in with Apple, Google, or an email code.

You are responsible for activity under your account and for keeping your sign-in method secure. Accounts are personal and may not be sold, shared, or transferred.

Virtual Items and Currency

The App contains virtual items and currencies, such as coins and diamonds. Coins are earned by playing. Diamonds can be earned or bought.

• Virtual items and currencies have no real-world monetary value and cannot be exchanged for real money, sold, or transferred outside the App.
• What you buy is a limited license to use that content in the App, not ownership.
• We may change, rebalance, or retire virtual items as the game evolves. We will not intentionally remove purchased content without reason; if a paid feature is permanently discontinued, we will try to provide a reasonable in-game equivalent.

Purchases

All purchases are processed by the Apple App Store or Google Play and are subject to their terms. Prices are shown in the App before you confirm a purchase and may vary by country. Refunds are handled by Apple or Google under their refund policies; we cannot issue refunds directly.

Purchased content is delivered to your account right away. If you are a consumer in the EU, by confirming the purchase you ask us to deliver the digital content immediately and acknowledge that your right of withdrawal ends once delivery has started.

If a purchase does not arrive, try "Restore Purchases" in the App or contact us.

Harvest Club Subscription

Harvest Club is an optional, auto-renewing subscription that unlocks the extra benefits described in the App.

• Billing: payment is charged to your Apple or Google account when you confirm the purchase, or when the free trial ends if one is offered.
• Renewal: the subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
• Free trial: if a free trial is offered, you are charged when it ends unless you cancel at least 24 hours before. Apple or Google decide who is eligible for a trial.
• Cancelling: you can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancelling stops future renewals; you keep your benefits until the end of the current period. Deleting the App does not cancel the subscription.
• Changes: if the price changes, Apple or Google will notify you and, where required, ask for your consent before the new price applies.
• After it ends: subscription benefits stop. Items you have already collected, such as daily diamonds, stay in your account.

Community and Your Content

The App includes social features such as chat, co-ops, friends, the marketplace, and profile pictures. You keep ownership of what you post, but you give us a worldwide, royalty-free license to host, display, and distribute it within the App as needed to run these features.

You agree not to post or do anything that:

• Is hateful, harassing, sexual, violent, or otherwise inappropriate for a family-friendly game
• Shares personal information about yourself or others
• Advertises, spams, or links to outside services, or trades accounts or items for real money
• Infringes someone else's rights

You can report messages in the App. We may review, hide, or remove content and mute, suspend, or ban accounts or devices that break these Terms or our chat rules.

Fair Play

You agree not to:

• Use the App in any way that violates applicable laws
• Attempt to gain unauthorized access to the App or its systems
• Use cheats, exploits, automation software, bots, or unauthorized third-party software
• Interfere with or disrupt the App or its servers
• Impersonate any person, including our staff or moderators

If you find a bug or exploit, please report it to us instead of using it.

Changes to the App

We continuously update TinyHarvest and may add, change, or remove features and events. We may also need to end the service in the future; if we do, we will give reasonable advance notice in the App.

Disclaimer of Warranties

The App is provided "as is" and "as available". To the extent permitted by law, we make no warranties that the App will be uninterrupted, error-free, or free of harmful components. Your statutory rights as a consumer are not affected.

Limitation of Liability

We are fully liable for damage caused intentionally or through gross negligence, for injury to life, body, or health, and where liability is mandatory by law (for example, under the German Product Liability Act).

For slight negligence, we are only liable if we breach an obligation that is essential for the proper use of the App and that you may regularly rely on, and then only for typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.

Termination

You can stop using the App at any time and ask us to delete your account (see the Privacy Policy). We may suspend or terminate your access if you seriously or repeatedly break these Terms. Where reasonable, we will tell you why.

App Store and Google Play

These Terms are between you and us, not Apple or Google. We, not Apple or Google, are responsible for the App and its content, maintenance, support, and any claims relating to it. If you downloaded the App from the Apple App Store:

• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, or consumer protection claims.
• Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App infringes intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

Changes to These Terms

We may update these Terms, for example when we add features or when the law changes. We will post the new version on this page and update the "Last updated" date, and tell you in the App about significant changes. If you keep using the App after a change takes effect, the updated Terms apply.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
